Do You Need A Lawyer To File An Uncontested Divorce?

While everyone who has walked down the aisle and said "I do" meant that they would stay with their partner 'til death do they part, sometimes things happen that make that impossible. Many people feel that having children requires you to fight over child support and custody in front of a judge. Many courts lead divorcing couples to believe that this is the case. However, you can file an uncontested divorce even if you have children in most states. It is recommended that you consult an attorney when filing an uncontested divorce with children to insure all paperwork is filled out completely and every aspect of custody, support, and insurance is covered.

Your lawyer will provide you with the forms required by the courts and discuss what each item means and what you and your partner agree to. The attorney will then type the agreed upon information into the forms. Once all the forms are complete, you and your partner will sign each form and your attorney will present them to the judge for approval. The judge will then sign the papers into order and your attorney will provide you and your partner each with a copy.

Property

Just like children, property can be a hot button issue in divorces. If you own a home, cars, land, boats, or other valuable items, you may need to sit down with your partner to discuss the division of property. Try to keep the division as equal as possible without taking items you truly do not want or need. Having a divorce lawyer help with this process will insure all proper forms are completed to sign property over to the person receiving it and remove the person giving the items up.

For example, if you and your partner purchased a home and a car, he or she wants the house and you want the car, your lawyer would have you sign off on the house and your partner would sign the car over to you. This is particularly important in the case of joint property or property with one party's name on it when the other party is receiving it.
